Privacy notice on the processing of personal data pursuant to Article 13 of EU Regulation 2016/679 (GDPR)

Pursuant to European Regulation 2016/679 (GDPR), this page describes the methods of processing of the personal data of Users who browse the website and interact with the web services of the company KLOVER, accessible electronically at www.klover.it, in compliance with the principles of fairness, lawfulness and transparency, with particular reference to confidentiality and the protection of personal data.
This information does not concern other websites, pages or online services, which may be accessed via hypertext links possibly published on the site, but which refer to resources external to the KLOVER domain.

Data controller

Browsing this site may involve the processing of data relating to identified or identifiable persons.
The Data Controller is KLOVER srl, in the person of the legal representative pro tempore, with registered office in 37047 San Bonifacio (VR), via A. All requests relating to the processing of personal data may be addressed to the Data Controller at the contact details indicated above.

Purposes and legal basis of the processing

Without prejudice to what is provided below with regard to navigation data, the personal data provided through consultation and interaction with this site may be processed for the following purposes, in compliance with the lawfulness conditions pursuant to Article 6, letter a) of the GDPR: performance of a contract to which the data subject is a party or performance of pre-contractual measures taken at the request of the same. With particular reference to the fulfillment of warranty obligations on products and after-sales assistance by KLOVER, the User has the option to provide their data in the KLOVER reserved area, through the “Register” form, if a Technical Assistance Center, or “Register your warranty”, if a private User.
Fulfillment of a legal obligation to which the Data Controller is subject, also for accounting and tax purposes.
Provision of the requested services (Newsletter, “Contacts” form, etc.), in relation to which the User has given consent to the processing of their personal data.

Types of data processed

A) Navigation data
The IT systems and software procedures used to operate this site acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols.
This information is not collected in order to be associated with identified data subjects, but by its very nature could, through processing and association with data held by third parties, allow Users to be identified.
This category of data includes IP addresses or domain names of the computers and terminals used by Users, URI/URL (Uniform Resource Identifier/Locator) addresses of the requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the User’s operating system and IT environment.
These data, necessary for the use of web services, are also processed for the purpose of:
obtaining statistical information on the use of services (most visited pages, number of visitors by time slot or day, geographical areas of origin, etc.);
checking the proper functioning of the services offered.

B) Data communicated by the user
The optional, explicit and voluntary sending of messages to KLOVER contact addresses, as well as the completion and submission of forms on the site, such as the “Contacts” form, subscription to the Newsletter and/or, in the reserved area of the site, registration of the warranty of the purchased product or registration by the retailer or Technical Assistance Center, entail the acquisition of the sender’s contact data, necessary to respond, as well as all personal data included in the communications.
The User assumes responsibility for the personal data of third parties shared through this site (by way of non-exhaustive example, data of the product installer, plumbing technician, maintenance technician) and guarantees that they have the right to communicate or disseminate them, releasing the Data Controller from any liability towards third parties.
The data collected will be retained for the time strictly necessary to carry out the activities indicated. Upon expiry of the period provided for by law, the data will be deleted or anonymized, unless there are further legal purposes for their retention.

C) Cookies and other tracking systems
Session cookies, which are not persistent, are used strictly limited to what is necessary for safe and efficient browsing of the sites. The storage of session cookies on terminals or browsers is under the control of the User, whereas on servers, at the end of HTTP sessions, information relating to cookies remains recorded in service logs, with retention times in any case equal to those of other navigation data.

Recipients of the data

The Data Controller may make use of Data Processors and persons authorized to process data.

The data collected following consultation of the site and/or submission of messages and forms by the User may be processed by the staff and/or collaborators and/or consultants of the Data Controller (by way of non-exhaustive example, Technical Office, Administration, consulting firm, site maintainers), who act on the basis of specific instructions provided regarding the purposes and methods of the processing.

Personal data will be communicated to third parties only to the extent strictly necessary to achieve the purposes of the processing. Therefore, such data may be communicated to:

  1. entities that provide services for the management of the IT system and communication networks, including email and the website,
  2. third-party service providers, including shipping services, with whom delivery addresses, contact information and shipment codes may be shared, in order to facilitate the delivery of products or components of products and other communications related to delivery.

Third-party service providers have access only to the personal data that are necessary for the performance of their activities, but may not process the data they become aware of for further purposes. Furthermore, such third parties are required to process the personal data they become aware of in accordance with this Privacy Notice and applicable personal data protection regulations.

The subjects belonging to these categories perform the function of Data Processors, or operate in full autonomy as separate Data Controllers. Finally, it should be noted that the data may be communicated to the competent authorities that request them for the fulfillment of legal obligations.

Transfer of data outside the EU.

Personal data will not be transferred outside the European Union, except as indicated below for the Newsletter service. Otherwise, the Data Controller will ensure that such transfer takes place in compliance with applicable legislation and that an adequate level of protection of personal data is guaranteed, on the basis of an adequacy decision, standard clauses defined by the European Commission or Binding Corporate Rules (BCR).

With specific reference to the Newsletter, it should be noted that this service is managed through MailChimp and, therefore, Users are invited to review the relevant Privacy Policy.

Under no circumstances will personal data be sold to third parties.

Rights of data subjects

With reference to their personal data, Users may exercise the rights recognized by the GDPR and, more specifically:

  • Withdraw consent given for data processing at any time.
  • Object to the processing of data when it is carried out on a legal basis other than consent.
  • Access, verify and request rectification of data.
  • Obtain restriction of data processing, in which case the Data Controller will not process the data for any purpose other than their storage.
  • Obtain erasure or removal of their data.
  • Receive their data or have them transferred to another controller. The User has the right to receive their data in a structured, commonly used and machine-readable format and, where technically feasible, to obtain their transfer to another Data Controller.
  • This provision applies when data are processed by automated means and the processing is based on the User’s consent, on a contract to which the User is a party or on contractual measures related thereto.
  • Lodge a complaint. The User may lodge a complaint with the competent personal data protection supervisory authority or take legal action.
